    ORDINANCE NO 2006-9 THIS ORDINANCE SHALL PERMIT THE SALE OF SECONDHAND, USED OR SURPLUS PERSONAL PROPERTY WITHIN THE CITY OF OZARK UNDER SUCH TERMS AND CONDITIONS AS HEREIN SET FORTH; TO PROVIDE DEFINITIONS FOR CLARITY, TO PROVIDE FOR THE ISSUANCE OF A PERMIT AND A FEE THEREFORE AND TO PROVIDE A PENALTY FORTHE VIOLATION OF THE ORDINANCE. BE IT ORDAINED by the City Council of the City of Ozark, Alabama as follows: Section 1. Authorization and Definition. Yard Sales are permitted within the municipal limits of the City of Ozark under certain terms and conditions as herein set forth. The term “Yard Sale” means and includes such terms as Garage Sale, Basement Sale, Carport Sale, Moving Sale, Rummage Sale, Flea Market Sale or any other type of residential sale of tangible personal property, such as, but not limited to, household items, clothing, tools, toys, recreation equipment or other used or secondhand items normally found in and about the home and advertised to the public. Section 2. Permit. A permit shall be required for any person(s) conducting a yard sale. The permit must be procured prior to the commencement of the sale and may be obtained in the office of the City Clerk. The Clerk is authorized to prepare a permit application form which shall include all pertinent information necessary to identify the sale site, the applicants, and the date and time for the permitted sale and shall contain such other information as the Clerk deems appropriate. The permit application shall not require the disclosure of the applicant’s social security number. There shall be no charge for the permit. Section 3. Conditions of Conducting the Sale. a. A property location may not be permitted for a yard sale more than twice in a calendar year. The property location shall be identified as the post office address assigned thereto and shall include the dwelling or any part thereof, yard, open field, barn, accessory building and parking area. b. A sale may be conducted by a single person, multiple persons, churches, social, civic or charitable organizations. All items to be sold must originate as the legal property of the applicant, other persons participating in the sale or members of the organizations. Goods must be surplus to the needs of the owner and shall not include any items purchased new for resale at the yard sale. c. A permitted yard sale shall be limited to three consecutive days of operation and must be conducted during daylight hours only. d. Yard sales may be conducted on private property or public property with permission and provided no merchandise shall be placed upon public rights-of-way, including streets and sidewalks. All merchandise must be displayed a sufficient distance from public roadways in order to avoid obstruction of view or traffic hazards. e. All unsold yard sale merchandise remaining on the permitted site at the conclusion of the sale must be removed therefrom immediately. Merchandise sold to purchasers must be removed from the permitted sale site within 24 hours of the conclusion of the sale. f. The issuance of a yard sale permit shall signify the consent and permission for personnel of the City of Ozark, including law enforcement officers, to enter the permitted sale site to monitor, inspect and determine compliance with this Ordinance. Section 4. Advertising of Yard Sales. A yard sale may be advertised to the public by means of newspapers, radio, television, cablevision, handbills and signs. In the event an applicant chooses to advertise a permitted yard sale by means of signage or handbills, the following restrictions shall apply, to wit: a. No more than two signs may be placed upon the permitted property. b. Signs and handbills cannot be placed on utility poles, public property including rights-of-way, nor may signs be placed on private property which is not the permitted site. Handbills may be posted on private bulletin boards or inside places of business with the consent of the owner. c. A sign is limited to four square feet or less and shall not be illuminated or animated. d. A sign may not be displayed more than one day prior to the commencement date of the sale and must be removed immediately following the conclusion of the sale. Section 5. Exceptions. This ordinance shall not apply to or affect the following persons or sales: (a) Persons selling goods pursuant to an order or process of a court of competent jurisdiction. (b) Persons acting in accordance with their powers and duties as public officials or as court appointed personnel representatives of estates. (c) Persons selling or advertising for sale an item of personal property which is specifically named or described in the advertisement and which separate items do not exceed ten in number. (d) Persons moving and relocating outside the City of Ozark, provided such sale is limited to one week and must be conducted no earlier than one month prior to departure. (e) Sales conducted by bona fide civic or charitable organizations where the net proceeds are distributed to charity, public purposes or community goals or projects. Section 6. Penalty. Any person conducting a yard sale without being properly permitted or who should violate any of the other terms and regulations contained in this ordinance shall upon conviction be guilty of constitute a Class C Misdemeanor and may be punished, by a fine not less than $15.00 nor more than $500.00 at the discretion of the Municipal Judge. Section 7. Effective Date. After publication as required by law, this ordinance shall become effective September 1, 2006.     POLICE OPPORTUNITIES ... BACK TO HOME Recruitment and Opportunities The Ozark Police Department is staffed by well-trained and highly qualified employees with a dedication to service. The department staffing consists of 45 Sworn Law Enforcement Officers. Additionally, the department is staffed with a support staff of administrative employees, corrections officers, school crossing guards, code enforcement officers, and animal control officers. The divisions that encompass law enforcement services are the Patrol Services Division, Criminal Investigative Division, and Narcotics Division. To become a police officer you must be a high school graduate or have your GED. You must also be at least 19 years of age and must not have a criminal background and must be mentally stable to possess a firearm. To be a police officer, the Ozark Police Department requires applicants to meet state standards for entrance into a state police academy plus a written examination is given to all applicants after completion of a state-approved physical ability test. The test consists of 22 push-ups within a minute, 25 sit-ups within a minute, and lastly, the applicant has to run 1.5 miles within 15:28 minutes.     Absentee Voting Information Eligible voters who are unable to vote in person on Election Day may vote by absentee ballot. There are two convenient options available: In-Person Absentee Voting at City Hall Absentee Voting by Mail 1.     Boards and commissions are important in that they enable citizens to participate in Ozark's government processes. Their activities help shape and influence public policy. While some boards and commissions are appointed entirely by City officials, the Mayor, and/or the City Council, others are jointly appointed by the City and other organizations. If you are interested in volunteering your time to serve on a board or commission, please contact the Mayor’s office at 334-774-3300. Below is a list and description of active Boards and Commissions for the City of Ozark and Ozark-Dale County: Airport Advisory Board The purpose of the board is to provide assistance and guidance to city officials concerning the development and operation of the airport including meeting with other airport officials, Federal Aviation Administration representatives, and Alabama Department of Aeronautics representatives in an official capacity. E-911 Commissioners The district board of commissioners shall have the following authority:(1)Levy on all of the telephone subscribers within the district an emergency telephone service charge in an amount not to exceed five (5) percent of the tariff rate.(2)Obtain the necessary lines and equipment to provide enhanced universal emergency service or E-911 service, as defined in Act 96-47.(3)Collect from local telephone companies on a monthly basis the amount collected from these companies attributable to the emergency telephone service charge.(4)Disburse funds collected from the emergency telephone service charge, or any other sources in the discharge of its responsibilities under law;(5)Where the revenues set in (1) above prove to be in excess of the amounts needed to operate the service, the board of commissioners may reduce the subscribers' levy according to law;(6)Determine from the options defined in Act No. 96-47 the most feasible means of responding to the emergency calls from within the communications district. (7)Any other functions authorized by Act No. 96-47 including entering into additional cooperative agreements with other E-911 systems as is deemed necessary or advisable. Industrial Development Board Contact the Mayor's office at 334-774-3300 . The Industrial Development Board is governed by the Code of Alabama 1975, Sections 11-54-80 through 11-54-101. Its primary responsibility is to promote industrial and economic development within the City of Ozark and the surrounding area. The Board works to attract new industries and support the expansion of existing businesses in order to increase employment opportunities, strengthen the local tax base, and enhance overall economic growth. To carry out this purpose, the Board is authorized to plan, acquire, construct, improve, and finance industrial projects and related facilities. It may purchase, lease, or otherwise acquire property; issue bonds to finance projects; lease facilities to private enterprises; and enter into contracts and agreements necessary to support industrial development initiatives. The Board acts as a landlord and financing entity rather than operating businesses directly and is responsible for managing its properties and financial obligations in accordance with state law and public governance requirements. The Industrial Development Board consists of seven members appointed by the Ozark City Council to six-year terms and meets on an as-needed basis. Ozark Parks & Recreation Board The purpose and goal of the board shall principally be, but not limited to, providing guidance and recommendations for programs and facilities, which provide for the recreational and leisure activity needs of the city. The board shall assist in the planning and development of new opportunities to provide recreation and leisure activities and to make recommendations concerning the most effective use of existing programs. Medical Clinic Board Contact the Mayor's office at 334-774-3300 . The Medical Clinic Board of the City of Ozark was formed pursuant to Ala. Code § 11-58-1, et seq., as an instrumentality of the State of Alabama for the purpose of promoting public health through the acquisition and support of health care facilities. The Board serves as a conduit entity for Dale Medical Center. The Medical Clinic Board consists of three members appointed by the Ozark City Council to six-year terms and meets on an as-needed basis. Planning Commission The planning commission is authorized and empowered to make and adopt a master plan for the physical development of the city, including any areas outside its boundaries which, in the commission's judgment, bear relation to the planning of such municipality. Public Building Authority Contact the Mayor's office at 334-774-3300 . Municipal Public Building Authorities are governed by the Code of Alabama 1975, Sections 11-56-1 through 11-56-22. The purpose of the Authority is to provide buildings and facilities for lease to and use by the municipality, county, or other public corporations in the performance of their public functions, as well as for lease to and use by the United States government. The Authority is granted all powers necessary to carry out this purpose, including the authority to acquire property, construct buildings, lease its facilities, and issue interest-bearing revenue bonds. Revenue generated from long-term leases may be used to repay bond obligations. The Public Building Authority is required to obtain competitive bids for the construction of buildings or improvements with a cost exceeding $50,000. The Public Building Authority consists of three members appointed by the Ozark City Council to six-year terms and meets on an as-needed basis. Ozark–Dale Technology Center for Development Industry Advisory Board The purpose and goal of this board shall primarily be to, but not limited to, advance knowledge and understanding of economics, matters of public concern, finance, education and training, science and technology, economic planning and development and other subjects related to improved efficiency, development and acceleration of both quality and quantity of economic growth and employment opportunities for the occupants of the technology center. Tree Board It shall be the responsibility of the Tree Board to study, investigate, counsel and develop, and/or update annually, and administer a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of trees and shrubs in parks, along streets and in other public areas. Such a plan will be presented annually to the city council and upon its acceptance and approval shall constitute the official comprehensive city tree plan for the city. The board, when requested by the city council, shall consider, investigate, make findings, report and recommend upon any special matter of question coming within the scope of its work. Utilities Board The board of directors for the utility board of the municipality oversees the waterworks plant and distribution system and the sanitary sewer system. Wiregrass Mental Health Contact the Mayor's office at 334-774-3300 . The Wiregrass Mental Health Board is governed by the Code of Alabama 1975, Sections 11-58-1 through 11-58-15. Its purpose is to promote access to medical and mental health services by creating, improving, and managing clinical facilities that serve the public. To fulfill this mission, the Board is authorized to issue bonds; acquire, lease, and manage property (including the use of eminent domain when permitted by law); and enter into agreements necessary for the construction, financing, operation, and maintenance of mental health clinics and related facilities. The Wiregrass Mental Health Board consists of two members appointed by the Ozark City Council to six-year terms and meets on an as-needed basis.
