Election Information The City of Ozark elects the following positions at each 4-year election term: Mayor Council Members - currently 5 at-large members The Alabama League of Municipalities has published "Duties of the Mayor and Council " to help understand the distinct roles and separation of duties. Ozark's last election was held in 2020. In 2021, the Alabama State Legislature voted to move municipal elections off the same calendar year as presidential elections. Officials elected in 2020 will serve until 2025. Municipal elections will be held on the 4th Tuesday in August 2025. The City Clerk's office is responsible for overseeing the election process. ORDINANCE NO 2006-9 THIS ORDINANCE SHALL PERMIT THE SALE OF SECONDHAND, USED OR SURPLUS PERSONAL PROPERTY WITHIN THE CITY OF OZARK UNDER SUCH TERMS AND CONDITIONS AS HEREIN SET FORTH; TO PROVIDE DEFINITIONS FOR CLARITY, TO PROVIDE FOR THE ISSUANCE OF A PERMIT AND A FEE THEREFORE AND TO PROVIDE A PENALTY FORTHE VIOLATION OF THE ORDINANCE. BE IT ORDAINED by the City Council of the City of Ozark, Alabama as follows: Section 1. Authorization and Definition. Yard Sales are permitted within the municipal limits of the City of Ozark under certain terms and conditions as herein set forth. The term “Yard Sale” means and includes such terms as Garage Sale, Basement Sale, Carport Sale, Moving Sale, Rummage Sale, Flea Market Sale or any other type of residential sale of tangible personal property, such as, but not limited to, household items, clothing, tools, toys, recreation equipment or other used or secondhand items normally found in and about the home and advertised to the public. Section 2. Permit. A permit shall be required for any person(s) conducting a yard sale. The permit must be procured prior to the commencement of the sale and may be obtained in the office of the City Clerk. The Clerk is authorized to prepare a permit application form which shall include all pertinent information necessary to identify the sale site, the applicants, and the date and time for the permitted sale and shall contain such other information as the Clerk deems appropriate. The permit application shall not require the disclosure of the applicant’s social security number. There shall be no charge for the permit. Section 3. Conditions of Conducting the Sale. a. A property location may not be permitted for a yard sale more than twice in a calendar year. The property location shall be identified as the post office address assigned thereto and shall include the dwelling or any part thereof, yard, open field, barn, accessory building and parking area. b. A sale may be conducted by a single person, multiple persons, churches, social, civic or charitable organizations. All items to be sold must originate as the legal property of the applicant, other persons participating in the sale or members of the organizations. Goods must be surplus to the needs of the owner and shall not include any items purchased new for resale at the yard sale. c. A permitted yard sale shall be limited to three consecutive days of operation and must be conducted during daylight hours only. d. Yard sales may be conducted on private property or public property with permission and provided no merchandise shall be placed upon public rights-of-way, including streets and sidewalks. All merchandise must be displayed a sufficient distance from public roadways in order to avoid obstruction of view or traffic hazards. e. All unsold yard sale merchandise remaining on the permitted site at the conclusion of the sale must be removed therefrom immediately. Merchandise sold to purchasers must be removed from the permitted sale site within 24 hours of the conclusion of the sale. f. The issuance of a yard sale permit shall signify the consent and permission for personnel of the City of Ozark, including law enforcement officers, to enter the permitted sale site to monitor, inspect and determine compliance with this Ordinance. Section 4. Advertising of Yard Sales. A yard sale may be advertised to the public by means of newspapers, radio, television, cablevision, handbills and signs. In the event an applicant chooses to advertise a permitted yard sale by means of signage or handbills, the following restrictions shall apply, to wit: a. No more than two signs may be placed upon the permitted property. b. Signs and handbills cannot be placed on utility poles, public property including rights-of-way, nor may signs be placed on private property which is not the permitted site. Handbills may be posted on private bulletin boards or inside places of business with the consent of the owner. c. A sign is limited to four square feet or less and shall not be illuminated or animated. d. A sign may not be displayed more than one day prior to the commencement date of the sale and must be removed immediately following the conclusion of the sale. Section 5. Exceptions. This ordinance shall not apply to or affect the following persons or sales: (a) Persons selling goods pursuant to an order or process of a court of competent jurisdiction. (b) Persons acting in accordance with their powers and duties as public officials or as court appointed personnel representatives of estates. (c) Persons selling or advertising for sale an item of personal property which is specifically named or described in the advertisement and which separate items do not exceed ten in number. (d) Persons moving and relocating outside the City of Ozark, provided such sale is limited to one week and must be conducted no earlier than one month prior to departure. (e) Sales conducted by bona fide civic or charitable organizations where the net proceeds are distributed to charity, public purposes or community goals or projects. Section 6. Penalty. Any person conducting a yard sale without being properly permitted or who should violate any of the other terms and regulations contained in this ordinance shall upon conviction be guilty of constitute a Class C Misdemeanor and may be punished, by a fine not less than $15.00 nor more than $500.00 at the discretion of the Municipal Judge. Section 7. Effective Date. After publication as required by law, this ordinance shall become effective September 1, 2006. MICHELLE MANN, DOTHAN EAGLE Ozark is a great City comprised of many very successful and memorable people. One such person is football legend, Wilbur Jackson. Mr. Jackson grew up in Ozark and started his athletic career playing football for Carroll High School. He went on to be the first African American player offered a football scholarship at the University of Alabama. After playing for several years under Coach Paul “Bear” Bryant, he was a first round NFL draft pick by the San Francisco 49ers. Mr. Jackson went on to play five seasons with San Francisco and three with Washington where he helped the team win Super Bowl XVII. After a successful football career, he retired and returned to his hometown of Ozark where he started and ran a successful cleaning business for many years. For some time we have been working on a project to honor Ozark legends like Mr. Jackson. Below you will find an artist rendering of a 26’ x 86’ mural that will be painted on the side of a building in downtown Ozark. Such a beautiful piece of artwork comes at a large price and this is where we need your help! Mayor Blankenship signed a proclamation declaring October 23 as “Make a Difference Day” in the City of Ozark. Once this day, volunteers will gather together to make a difference in the lives of others and in their community. Several projects are planned for the day, and volunteers are needed. Volunteers will meet at Ozark Baptist church at 7:30 a.m. on Saturday, October 23, for a light breakfast and to sign up for projects. Wiregrass Angel House is based in Dothan and services nine Alabama counties including Dale. They advocate for and assist victims of violent crime and their families. Mayor Blankenship met with Dr. Linda Young, president of Wallace Community College, today and proclaimed April as Community College Month. Wallace Community College fulfils a vital function within this region and is an essential part of our economic growth and development. You will be furnished a 96-gallon rollout garbage container to use while you are a resident of Ozark. Upon departure from your residence, please do not remove the garbage container, as it is the property of the City of Ozark. This container is authorized for disposal of residential garbage only. If you need an additional 96-gallon container, you may purchase one for $85 and it will be delivered to you. This price is effective as of August 1, 2008. Your garbage will be picked up once each week. Please place your container out next to the street by 7:00 a.m. on the day of your pick-up, and return it to the side or rear of your home by 7:00 p.m. the same day. Residential Trash Pick-up - Defined as - Things that are accumulated outside of the household such as tree limbs, shrubbery and grass trimmings, leaves, pine straw, large cardboard boxes (broken down), old play toys, old furniture, and general debris from the yard. Trash will be picked up throughout the City of Ozark on a rotation schedule. Trash should be placed near the street, not in the street or the gutter, but on the edge of your property. Trash placed in the street can pose a traffic hazard and clog storm drains during heavy rains which could cause flooding. Residents may put small electronics in their green garbage cans. Metal should be separated from the rest of the trash to be picked up for recycling. Grass clippings and leaves should be placed in a plastic bag and sealed tightly to prevent spilling. City crews will no longer be able to pick up any construction debris including the following: shingles, drywall, plaster, lumber, concrete, roofing materials, brick, carpeting, pads, commodes, lavatories, windows, doors, fencing, insulation, siding, or paint. Dirt, tree stumps, and tree trunks greater than ten (10) inches in diameter and five feet long will not be removed by the Public Works Department. Citizens who employ professional tree trimmers, tree removers, or pruners, must arrange for removal and disposal of such debris. The City will not pick up debris generated by tree trimmers, tree removers, tree pruners and contract labor or pulpwooders. Businesses that do not subscribe to City garbage service are not eligible for regular trash pickup. No extra charge will be made for residential trash pickup unless there is more than one half trailer load (10 cubic yards), in which case a fee of $65.00 per half load will be billed to the owner of the property. Individuals cleaning out entire houses must contact the Public Works Department before doing the actual work to receive instructions. Failure to comply could result in the assessment of a fine of up to $500.00 for criminal littering. For the 2025 Garbage Schedule, please see below: PW - Garbage/Trash PW - Garbage and Trash Schedule MOSQUITO CONTROL Mosquito Control There are various diseases that are transmitted by mosquitoes -Malaria, Encephalitis, Dengue Fever, and Yellow Fever. There are a few actions we can take to help prevent these diseases. Home Prevention: Remove all sources or potential sources of stagnant water. Standing water can become a breeding ground for mosquitoes in as little as four days. Old tires, buckets, wading pools and even birdbaths, (anything that can hold water), are a potential source for breeding. Emptying these containers on a regular basis, turning them over, or drilling small drainage holes in them will help. Self Prevention: When possible, stay indoors at dawn, dusk and early evening. Wear long-sleeved shirts and long pants whenever outdoors. Spray clothing and exposed skin lightly with mosquito repellent. Mosquitoes can bite through thin clothing. Whenever you use insect repellent, make sure you read any manufacturer's warnings and use them as directed by the manufacturer. Be extremely careful when using on children.
